US Judge Orders Freedom of Abrego Garcia from ICE Detention

A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement lacks lawful basis.

"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been re-detained, again without lawful authority," the judge wrote in her order.

The case stems from a erroneous deportation to El Salvador earlier this year, which the government later admitted was an error. Following his repatriation to the United States to face human smuggling allegations, he was detained in immigration custody.

In her order, the judge noted that the authorities does not have a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."

The legal challenge center on disputed assertions. While the Trump administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this claim.

He has also entered a not guilty plea to the conspiracy counts, which are part of a separate criminal case in the state of Tennessee.
